Selection process by lottery wheel

Arbitrators

§ 53.2 2016 DIS Sport Arbitration Rules:

“The parties or arbitrators nominated by the parties shall participate in the selection of the sole arbitrator or president of the arbitral tribunal. For this purpose, the DIS provides the parties or party-nominated arbitrators with a list of three persons ("List of Proposals"). Only persons who meet the requirements set out in § 53.1 may be considered for the List of Proposals. From this group, the DIS shall randomly select the three persons for the List of Proposals.”

The selection process described in Article 53.1 is implemented internally by the DIS by drawing names of arbitrator candidates from a lottery wheel.

This lottery wheel is kept locked and will only be opened for the purpose of drawing a name for the List of Proposals or in case an arbitrator qualified to decide anti-doping disputes is no longer available.

An employee of the DIS Case Management Sport Team, in the presence of another DIS employee, draws a name for the List of Proposals. This internal process is documented on a form, which contains the names of the candidates and the procedural information of the dispute. The form is signed by the employee of the DIS Case Management Sport Team and by the other DIS employee.
